Two MK Party Members of Parliament and former Transnet executives were released on bail Monday after appearing in the Pretoria Specialised Commercial Crimes Court on fraud and corruption charges related to a R93 million locomotives tender.
The accused – MPs Siyabonga Gama and Brian Molefe, along with former Transnet officials Anoj Singh and Thamsanqa Jiyane – face allegations of manipulating procurement processes during their tenure at the state-owned enterprise. The case forms part of the National Prosecuting Authority’s ongoing state capture investigations.
“The evidence shows systematic abuse of public funds through inflated costs and irregular payments,” said NPA spokesperson Mthunzi Mhaga. Prosecutors allege the 2015 locomotive deal caused significant losses to state coffers.
While the state didn’t oppose bail, strict conditions were imposed including:
• Surrender of all travel documents
• Weekly police station check-ins
• Ban on contacting state witnesses
The MK Party, which recently entered parliament, has remained silent on its members’ legal troubles. The case has drawn criticism from opposition parties questioning the party’s commitment to clean governance.
“This case tests South Africa’s resolve to tackle state capture corruption, regardless of political connections,” said political analyst Thandiwe Nkosi. “The public will watch closely whether justice is applied equally.”
The matter returns to court August 12 as investigators continue tracing the money trail. The accused maintain their innocence, with their lawyers describing the charges as “politically motivated.”
The case highlights ongoing challenges in addressing corruption from the state capture era, particularly when implicated individuals hold elected office. With billions allegedly looted from SOEs, this prosecution represents one of several high-profile cases moving through South Africa’s courts.
