Former President of the Republic of South Africa and African National Congress Jacob Zuma has written to the current President of South Africa and African National Congress, Cyril Ramaphosa, challenging the rationality of the appointment of Judge Raymond Zondo as Chief Justice of the Constitutional Court. Zuma claims that Zondo’s appointment was unconstitutional and that he is conflicted.

The former president has been embroiled in a longstanding dispute with Chief Justice Zondo, who is currently leading the commission of inquiry into state capture in South Africa. Zuma’s legal team alleges that Zondo’s impartiality has been compromised due to a personal relationship between the two men.

The legal challenge centers around Zondo’s appointment process to the Chief Justice position. Zuma’s lawyers argue that the Judicial Service Commission (JSC) failed to properly consider Zondo’s alleged conflict of interest and dishonesty during his interviews for the position.

Zuma’s legal team has also raised concerns about Zondo’s impartiality in the state capture inquiry, stating that Zondo has a personal vendetta against Zuma and that he has unfairly targeted the former president in his investigation.

During a press conference, Zuma’s lawyer, Muzi Sikhakhane, stated, “During JSC interviews one of the pertinent issues raised and which should have disqualified Judge Zondo was his clearly untruthful and dishonest account of meetings privately held with Former President Zuma.”

In response, Chief Justice Zondo has denied any impropriety and has stated that he will not recuse himself from the commission of inquiry. He has also expressed his commitment to the rule of law and the integrity of the South African judiciary.

The controversy has divided public opinion in South Africa, with some calling for Zuma to respect the independence of the judiciary, while others have supported his right to challenge the appointment of a Chief Justice who he believes to be conflicted.

This latest legal challenge is just one of the many legal battles Zuma has faced since leaving office in 2018. The former president is currently facing multiple corruption charges relating to his tenure in office and his alleged involvement in state capture.

Judges Matter’s advocacy officer Mbekezeli Benjamin shares his views on the demand made by former president Jacob Zuma for President Cyril Ramaphosa to remove Chief Justice Raymond Zondo from his position.
