Sesi Baloyi, spokesperson for the Judicial Service Commission (JSC), says Eastern Cape High Court Judge Belinda Hartle will continue carrying out her judicial duties until President Cyril Ramaphosa makes a final decision regarding her possible suspension.
Baloyi provided the update while addressing growing public attention surrounding the status of the judge and the ongoing processes involving the judiciary in South Africa.
“Until the President makes a decision, Judge Hartle remains in her position and continues performing her functions until it is decided whether or not to suspend her,” Baloyi explained.
The statement confirms that no immediate suspension has yet taken effect, meaning Belinda Hartle remains an active member of the bench despite the scrutiny and legal discussions surrounding her matter.
The process now rests with President Cyril Ramaphosa, who will ultimately determine whether suspension proceedings should move forward following recommendations and developments linked to the Judicial Service Commission.
The situation has attracted attention within legal and political circles, particularly because judicial accountability and judicial independence remain highly sensitive constitutional issues in South Africa.
The Judicial Service Commission plays a central role in overseeing judicial conduct, appointments, and disciplinary processes involving judges across the country.
While debate continues around the matter, Baloyi’s remarks clarify that Judge Hartle retains full judicial authority unless and until an official presidential decision changes her status.
Legal analysts note that such processes are often carefully managed to balance accountability with the constitutional protections afforded to members of the judiciary.
As the country awaits a final determination from the Presidency, the developments involving Belinda Hartle are expected to remain closely watched by both the legal profession and the wider public in South Africa.
