EFF leader Julius Malema appeared in the East London Magistrate’s Court on Friday for pre-sentencing proceedings after being convicted on multiple firearm charges last October.

Malema was found guilty of unlawfully possessing and discharging a firearm during the party’s 2018 birthday celebrations in Mdantsane. He has maintained the case is politically motivated and plans to appeal any sentence imposed.

The hearing allowed both the defense and prosecution to present evidence. Malema’s legal team submitted factors in mitigation of sentence, while the state argued for a stern penalty given the seriousness of firearm offenses in South Africa.

Legal expert William Booth explained that the court must weigh Malema’s personal circumstances, the nature of the offense, and the interests of the community. The prescribed sentence for unlawful possession of an automatic firearm is 15 years, but the court may impose less if “substantial and compelling circumstances” are shown.

Political analysts note that a prison sentence would end Malema’s role as an MP and could create leadership instability within the EFF. However, an appeal is expected, likely prolonging the legal process.

EFF supporters gathered in East London ahead of the hearing, calling the case a political attack. Magistrate Twanet Olivier is expected to deliver the sentence at a later date.
