Supreme Court to Review Black Coffee and Enhle Mbali’s Divorce Dispute

The Supreme Court of Appeal will review the ongoing divorce case between actress Enhle Mbali Mlotshwa and DJ Black Coffee this year, after Black Coffee was granted leave to appeal.

The Gauteng High Court had ruled in October 2024 that the couple entered into a valid customary marriage in May 2011, which was in community of property, and that their later civil marriage in 2017 was invalid. Black Coffee disputes the existence of the customary marriage and the court’s order to pay spousal maintenance.

In his appeal, Black Coffee argues there was no factual basis for the maintenance award and that his former wife did not demonstrate need, quantum, or duration. Mlotshwa maintains she provided detailed evidence of her needs and that her acting career was impacted during the marriage.

The High Court noted that the question of consent to a customary marriage is central to the case, making it suitable for appeal. The Supreme Court will now determine the validity of the customary marriage and the maintenance order.
