AfriForum Urges NPA to Charge Malema and Mbalula Over False Rape Allegations Against Limpopo Principal

AfriForum has requested the National Prosecuting Authority (NPA) to bring criminal charges against several political figures, including EFF leader Julius Malema and ANC Secretary-General Fikile Mbalula, for making what it calls reckless and defamatory statements about a Limpopo school principal who was wrongly accused of rape.

The controversy began in 2023 when serious allegations were made against the principal of a well-known secondary school in Limpopo. The accusations led to widespread public anger, with Malema, Mbalula, and other prominent figures condemning the principal before any official investigation was completed.

However, the NPA later concluded its investigation and found no credible evidence to support the rape or sexual misconduct claims. NPA spokesperson Mthunzi Mhaga stated, “There is no basis to prosecute the principal. The allegations could not be confirmed by any factual or forensic evidence.”

AfriForum’s head of the Private Prosecution Unit, Advocate Gerrie Nel, argues that the principal’s reputation and career have suffered irreparable harm. He insists that those who fueled public outrage without evidence must be held accountable.

“Public leaders must operate within the law and respect due process,” Nel said. “These individuals rushed to judgment, publicly condemning and damaging a man’s reputation without proof. Such actions should not go unchallenged.”

AfriForum is advocating for charges including crimen injuria, defamation, and incitement against those who made the public allegations. The organization warns that such behavior weakens the legal system and promotes trial by media rather than proper judicial processes.

Neither Malema nor Mbalula has formally responded to the NPA’s findings or AfriForum’s call for legal action. Meanwhile, the principal, whose identity remains confidential, is reportedly exploring legal options for a civil damages claim.

AfriForum has indicated that if the NPA does not take action, it may pursue private prosecution, potentially leading to a high-stakes legal confrontation with significant political consequences.
