A commission of inquiry has turned its attention to a key legal question: whether an affidavit provided sufficient grounds for the Independent Directorate Against Corruption (IDAC) to assume jurisdiction in its investigation involving General Khumalo.

During the proceedings, legal representatives examined the circumstances under which the affidavit was submitted and whether its contents met the legal threshold required to trigger IDAC’s involvement. The issue is central to determining whether the investigation was initiated within the scope of the agency’s statutory powers.

Counsel argued that the commission must carefully assess both the wording of the affidavit and the legal framework governing IDAC’s investigative mandate. Commissioners also heard submissions on the procedures followed before the investigation commenced and whether all jurisdictional requirements were satisfied.

The inquiry is expected to evaluate documentary evidence, witness testimony, and relevant legislation before reaching any conclusions. Legal experts note that establishing jurisdiction is a fundamental step in ensuring the validity and integrity of any investigation.

No findings have been made, and the commission emphasized that the proceedings remain ongoing. Any conclusions regarding the legality of IDAC’s involvement or the conduct of those connected to the matter will be based on the full body of evidence presented during the hearings.

The commission is expected to continue hearing testimony as it works toward recommendations aimed at strengthening accountability, legal compliance, and public confidence in investigative institutions.
