Khusela Diko Demands Immediate Withdrawal of Malatsi’s ICASA Policy While Raising Legal Concerns

Khusela Diko, the chairperson of Parliament’s Communications and Digital Technologies Committee, has called for the urgent rescission of the new policy regulations enacted by Minister Solly Malatsi to the telecoms regulator ICASA. She stated that these regulations exceed legal boundaries and must be halted.

Diko clarified that the policy might alter significant regulations within the telecommunications sector without appropriate authorisation. She stated that it could impact initiatives to promote fairness within the industry and to provide greater opportunities for historically disadvantaged groups. The committee is concerned that the policy may not be in full compliance with the law and could lead to issues if it persists.

She also stated that the minister failed to adequately consult with other government agencies or Parliament prior to promulgating the regulations. The committee intends to conduct a thorough evaluation of the matter early next year to ensure compliance with the law and to maintain the fairness and accessibility of telecommunications services for all South Africans.

The minister justified his actions, asserting that the policy is lawful and intends to promote the expansion of internet access and investment. Nonetheless, Parliament and numerous members continue to express concerns and advocate for the review and potential removal of the directives if deemed necessary.
