Adv Mshololo blows hot in court as she accuses Judge Ratha Mokgoatlheng of supporting prejudice

During yesterday’s court session with regards to the inquiry into Senzo Meyiwa’s murder, the state called a new witness, Sergeant Vusumuzi Mogane to come testify in court with regards to Senzo Meyiwa’s murder trial. Advocate Zandile Mshololo on the other hand, objected to the leading of the evidence by the new witness, as she argued that section 205 evidence, which relates to cellphone data download evidence from accused 5’s cellphone, had not been attached to the evidence. She said that her client was suffering prejudice as a result.

The state said that the evidence would be limited to the confiscation of the cellphone and not the section 205 evidence while issues around that were still being finalized. The state also said that they had spoken to the defense about this matter during the break.

Mshololo argued that the entire evidence should be paused wholly and not be limited to the confiscation of the cellphone, until all the issues had been sorted out and all the information was ready.

The state’s decision to call a new witness at this stage of the trial is significant. The new witness is expected to testify about cellphone data download evidence, which could be crucial in determining the whereabouts of accused 5 on the day of the murder.

The defense’s objection to the leading of the evidence is also significant. The defense is concerned that the state is trying to introduce new evidence that they have not had a chance to examine.

The outcome of the Senzo Meyiwa murder trial is of great interest to the South African public. Meyiwa was a popular and respected figure, and his death was a major tragedy. The trial is also being closely watched by the international community, as it is a high-profile case involving the murder of a prominent athlete.

Section 205 of the Criminal Procedure Act allows the police to apply for a court order to obtain cellphone data download evidence from a mobile network operator.
